Terms of Use – Tattvue

1. What this is about
These terms apply to the use of the Tattvue app, offered by Theodor Staubach, An der Bogenheide 45, 16348 Wandlitz, Germany, email: contact@tattvue.com.
By creating an account you agree to these terms.
2. What Tattvue does – and what it does not
Using artificial intelligence, Tattvue generates a preview of how a tattoo motif could look on a body area you choose. For this we use AI services from external providers; which these are, and where your data goes in the process, is set out in the privacy policy. You can upload your own motif or have one generated from a text description.
Important, so that no false expectation arises here:
- The result is a non-binding visual approximation, not a promise of how a real tattoo will look later.
- AI results vary. It can happen that an image becomes inaccurate, that details shift or that an attempt fails.
- The app is not advice. Whether and where you get tattooed, and whom you commission to do it, is your decision alone.
3. Account and minimum age
To use the app you need an account (email and password, or sign-in via Google or Apple). You provide accurate information and keep your password secret. You are responsible for everything that happens through your account – unless it is not your fault, for example because your credentials were stolen. In such a case please contact us immediately.
The app is intended for people aged 18 and over. By creating an account you represent that you are at least 18 years old and legally able, under the law where you live, to enter into this agreement. In some countries and US states the age of majority is above 18; if you have not reached it where you live, you need the consent of your legal guardian to the extent your local law requires it. People under 18 may not use the app – not even with the consent of a parent or guardian. One reason for this is that the AI services we use prohibit their use in offerings that are directed at, or likely to be accessed by, individuals under the age of 18.
One account per person is permitted. If you create several accounts in order to receive credits more than once, we may block the accounts concerned and exclude the device used from further credits.
4. Credit, subscription, prices and purchase
4.1 Two ways to use Tattvue
There are two separate options, and you can also use them alongside each other:
- Image packages (credit): you buy a package of images once and use them whenever you want. Nothing renews automatically, and nothing is charged without you triggering it.
- Subscription: you pay regularly and receive an allowance with every payment. A subscription renews automatically until you cancel it.
4.2 Prices
Image packages (one-off):
3 images – EUR 5.99 (EUR 2.00 per image)
8 images – EUR 12.99 (EUR 1.62 per image)
20 images – EUR 29.99 (EUR 1.50 per image)
Subscription (renews automatically):
Monthly – EUR 8.99 per month, for 5 images and 10 motif creations per paid month
Yearly – EUR 69.99 per year, for a total of 50 images and 100 motif creations per paid year, released in two parts (see 4.5)
All prices are final prices and apply to Germany. The purchase is handled through the app store on your device (section 4.6); that store shows any value added tax that may apply and pays it over. We ourselves, as a small business within the meaning of section 19 of the German Value Added Tax Act, do not show value added tax. Amounts may differ in other countries and currencies. The price shown to you on the purchase screen always prevails.
4.3 What an image is and what a motif is
An image is a finished tattoo preview: your motif on your photo. A motif creation is a design generated by AI from a text description.
Uploading your own motif is always free and included in every type of use – even without a purchase and without a subscription.
4.4 What is included in packages and in the subscription
Images are included in both: in a package in the quantity purchased, in a subscription within the allowance of the respective payment. You can upload your own motif in both.
AI motif creation is reserved for subscribers; any remainder from a subscription that has ended stays yours, though (section 4.8). With an image package you create images exclusively with a motif you upload yourself.
4.5 How the subscription allowance is released
The allowance is not available to you all at once but in parts:
- Monthly subscription: with every monthly payment, 5 images and 10 motif creations are released.
- Yearly subscription: per paid year, 25 images and 50 motif creations are released twice – once on purchase and once three months later. Together that is 50 images and 100 motif creations per paid year.
Unused allowance stays yours: a new release is added to the balance you already have, it does not replace it.
4.6 Handling of the purchase
Purchases and subscriptions are handled entirely through the app store on your device (Apple App Store or Google Play); the terms of that store apply in addition. From there we receive only the confirmation of the payment and credit your account with the credit or the allowance. Refunds likewise run through the respective app store.
4.7 Term and cancellation of the subscription
Depending on the variant chosen, a subscription runs for one month or one year and renews automatically for the same period unless you cancel.
You can cancel at any time with effect from the end of the current payment period – in the settings of your app store account, not with us. Apple generally requires cancellation at least 24 hours before the period ends. Until the end of the paid period you can continue to use the allowance already released.
4.8 Validity of credit and allowance
What you have paid for does not expire – neither through the passage of time nor because your subscription ends:
- Purchased package credit has no expiry date.
- If your subscription ends – through cancellation, expiry or a failed payment – you keep the allowance that has already been released and that you have not used yet. The remaining images become ordinary package credit. Your remaining AI motif creations also stay yours and you can use them up without a subscription; new AI motifs are only added while a subscription is running.
- Parts that would only have fallen due after your subscription ended are no longer released (section 4.5).
- If a purchase is refunded to you, the corresponding credit or allowance is removed. Anyone who gets their money back does not keep the service.
Both are tied to your account, are not transferable and cannot be paid out in money.
If you delete your account yourself, any remaining credit expires. We point this out to you in the app before deletion is carried out. You must additionally cancel a running subscription in your app store account – deleting your Tattvue account does not end the subscription there.
If we block your account because of a breach (section 10), your credit is suspended for the duration of the block. If we terminate the contract permanently, we refund paid, unused credit. Not refunded are credits for which you paid nothing (free image, invitation and gift credit) as well as credit you obtained by deception.
5. Free image, invitations and gift codes
- Free image: there is one free image for trying the app out. It is granted once per device and carries a clearly visible Tattvue watermark across the image. It is meant for trying out, not as a finished result.
- Invitation code: every account has a personal code. As soon as an invited person makes their first purchase – an image package or a subscription – you both receive one additional image. No entitlement arises before that, not even by creating images. For the invited person this applies once, and once per device.
- Gift codes: a gift code credits the number of images stored on it. Each code can be redeemed only once.
For all three the following applies: they include images but no AI motif creation (section 4.4). You use a motif you have uploaded yourself for them.
Free of any watermark are all images from purchased packages, from a subscription and from invitation and gift credit. Only the one-off free image is marked.
These credits are voluntary extras. There is no entitlement to them; we may change or discontinue them for the future. Images already credited remain yours. Anyone who obtains credits by trickery – for example through chains of sham accounts – loses them.
6. Usage limits to protect against misuse
A maximum of 75 image creations and 75 motif creations per account and day is possible. This limit protects us against misuse and does not affect normal use. It does not give you any additional credit – your purchased credit continues to apply independently of it.
In addition, short-term limits apply that slow down a burst. At present these are up to 20 creations per account and hour, up to 30 per device and hour and up to 100 per device and day. Unlike the daily limit above, these are personal limits: they can affect you even if you have bought credit.
Alongside them we use technical protective limits that cap the overall load – per network address, for the number of simultaneous creations and for the service as a whole – as well as a cap on the number of free trial images we hand out per day.
All of these limits may mean that a creation is temporarily not possible. In that case your credit is not charged and you can try again shortly afterwards. Your purchased credit does not expire as a result.
7. Withdrawal, refunds and cancellation
7.1 Who your contracting party is when you buy
You do not conclude purchases and subscriptions with us, but with the operator of the app store. On the iPhone that is Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland. Under its own terms, Apple is the merchant of record for everything you buy in the App Store and inside an app. We provide the service, but you pay Apple.
7.2 Your right of withdrawal or refund for purchases and subscriptions
Because Apple is your contracting party, your right of withdrawal for image packages and subscriptions follows Apple’s terms, and those terms differ by country. If you live in the United Kingdom or in Ireland, you have a statutory 14-day right to cancel; Apple sets out its own cancellation information and a model cancellation form in the terms for your country, which you reach from https://www.apple.com/legal/internet-services/itunes/ww/. If you live in the United States, there is no comparable statutory right of withdrawal; Apple still reviews refund requests under its own rules.
Request a withdrawal or refund directly from Apple – fastest via “Report a Problem” at https://reportaproblem.apple.com.
We can neither reverse nor refund a purchase; we only see it as confirmation of payment. If you get your money back, the associated credit or allowance is removed (section 4.8).
7.3 Your right of withdrawal for your Tattvue account
For the Tattvue account itself you conclude a contract with us. It costs nothing. You have 14 calendar days to withdraw from it, without giving any reason and at no cost. The period starts on the day the contract is concluded, that is, the day your account is created. To withdraw, send us a clear statement (for example a letter or an e-mail) to Theodor Staubach, An der Bogenheide 45, 16348 Wandlitz, Germany, contact@tattvue.com. Sending it before the period ends is enough.
We do not apply any early lapse of this right to this contract: we do not ask you to confirm anything or tick any box, and the period runs in full even if you are already using the app.
If you withdraw, your use relationship with us ends. We delete your account and its associated data in line with our Privacy Policy. You have made no payment to us for this account, so there is nothing to refund and you owe us nothing for the time you have already used the app. Your purchases and subscriptions are not affected; section 7.2 applies to those.
Independently of this you can delete your account at any time in the settings (section 10).
7.4 Cancelling is not withdrawing
You can cancel a subscription at any time with effect from the end of the current payment period, in the settings of your app store account (section 4.7). Cancellation only ends the automatic renewal for the future. It does not refund the period already paid for. The automatic renewal of a subscription is not a new conclusion of contract, so no new withdrawal period starts with it.
8. Your responsibility for photos and motifs
You are responsible for what you upload. By uploading you warrant that
- you hold the necessary rights to the photo and the motif,
- people shown agree to the use – do not upload photos of other people without their consent,
- you do not upload photos of children and no images with sexual content.
Tattoo designs by others may be protected by copyright. Taking a motif from the internet may infringe the rights of the artist – please clarify that yourself.
Indemnity: If a third party asserts a claim against us because of a photo or motif you have uploaded, you will indemnify us against that claim to the extent that you are responsible for the infringement. This also covers the costs of a necessary legal defence in the statutory amount (German Lawyers’ Remuneration Act, RVG). You do not have to indemnify us to the extent that the claim results from our own conduct; your statutory rights remain unaffected.
In return, we undertake to inform you of such a claim without undue delay, to give you the opportunity to comment, and not to make any admission or enter into any settlement without your consent.
9. Prohibited use
You may not use the app in order to
- generate content that infringes the rights of third parties,
- generate insulting, discriminatory, violence-glorifying or otherwise unlawful content,
- expose, harass or deceive people,
- circumvent the technical protection of the app, for example by reading out the internal access token and addressing our server interfaces directly,
- query the app automatically on a mass scale or circumvent its usage limits.
10. Blocking and termination
You can delete your account yourself in the app at any time – under Settings, "Delete account". Deletion is carried out immediately. It covers your account data, your image creations, your feedback and ratings, all result images still held in temporary storage and the link between your purchases and your account. Two things deliberately remain: the note that a free trial image has already been used on your device, and a marker that Apple places on your device at our request and that we cannot delete. Both are explained in section 8 of the privacy policy. Alternatively an informal email to the address given above is sufficient; we then delete your account within 30 days and confirm this to you.
We may block or terminate your account if you breach these terms. In the case of minor breaches we give prior warning where that is reasonable. What happens to your credit in that case is set out in section 4.8.
We may discontinue the service. In that case we will inform you at least one month in advance and refund unused, paid credit on a pro rata basis.
11. Availability
We endeavour to provide reliable operation but do not owe uninterrupted availability. Maintenance work, disruptions at our service providers or force majeure may lead to interruptions.
If an image creation fails for technical reasons, no credit is deducted for it. Should credit nevertheless be lost on some occasion, contact us – we will credit it to you.
12. Rights in the generated images
You may use the images generated with the app freely, including commercially, and we make no claims to them.
An honest note: images generated purely by AI are as a rule not protected by copyright under the law currently applicable in Germany. You may therefore not be able to prevent others from using such an image. Nothing changes with regard to the photo you uploaded yourself – that remains yours.
13. Defects and liability
The statutory rules on defects in digital products apply (sections 327 et seq. of the German Civil Code).
We are liable without limitation for intent and gross negligence, for damage arising from injury to life, body or health, under the German Product Liability Act and in so far as we have given a guarantee.
In the case of ordinary negligence we are liable only for breach of a material contractual obligation – that is, an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. In that case liability is limited to the damage foreseeable at the time the contract was concluded and typical for this type of contract. Otherwise liability is excluded.
We are expressly not responsible for your decision to get tattooed, or for its consequences. A preview in this app is not a promise about the result at the tattoo studio.
14. Changes to these terms
We may change these terms where there is an objective reason for doing so, for example new features or a changed legal situation. We will inform you of changes at least six weeks in advance in the app or by email.
Changes only apply if you agree to them. We obtain your agreement in the app. If you do not agree, the previous terms continue to apply to you; we may then end the contract with one month’s notice and refund unused, paid credit. We do not treat your silence as agreement.
The prices of packages already purchased do not change as a result.
If we change the price of a subscription, the new price applies only from the next renewal. We will inform you in good time beforehand so that you can cancel before the renewal; no higher amount will be charged without your consent.
15. Final provisions
German law applies. As a consumer you do not thereby lose the protection of mandatory provisions of your country of residence.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
Should any provision of these terms be invalid, the remainder stays valid.
